ARTICLE I – INTRODUCTION AND ACCEPTANCE

1.1 Overview

This Enterprise Legal Policy (“Policy”) governs the access and use of all services, platforms, websites, event infrastructure, applications, communications, digital assets, and resources (collectively, the “Platform”) provided by Amplify Women Tampa Bay, LLC, a Florida limited liability company (“Amplify,” “we,” “our,” or “us”).

1.2 Agreement to Terms

By accessing or using the Platform, you (“User”) agree to be bound by this Policy, including the Terms of Use (Article II), Privacy Policy (Article III), and Cookie Notice (Article IV). If you do not agree, you must not use the Platform.

ARTICLE II – TERMS OF USE

2.1 Eligibility

Use of the Platform is limited to individuals 18 years of age or older.

2.2 Ownership and IP

The Platform and its contents—including but not limited to trademarks, graphics, service offerings, program materials, directory structures, sponsorship displays, and all associated software—are proprietary to Amplify or licensed to it. Use of any material without express written permission is prohibited.

2.3 Permitted Use

User agrees to access and use the Platform solely for lawful, personal or professional purposes related to Amplify’s community events, sponsorships, coaching programs, or affiliated offerings. Unauthorized access, misuse, or scraping is prohibited.

2.4 Restrictions

• Reverse-engineer, decompile, or tamper with the Platform
• Upload harmful, unlawful, or infringing content
• Impersonate others or falsify identity
• Interfere with Amplify’s systems or third-party integrations

2.5 Limitation of Services

Amplify reserves the right to alter or discontinue any part of the Platform without prior notice.

2.6 Indemnification

User agrees to defend, indemnify, and hold harmless Amplify, its directors, officers, employees, and vendors against any third-party claims arising from use of the Platform, breach of this Policy, or violation of any applicable law.

2.7 Governing Law

This Policy is governed by the laws of the State of Florida. Exclusive venue lies in the Thirteenth Judicial Circuit in Hillsborough County, Florida.

2.8 Severability

If any provision is deemed invalid, the remainder shall remain in force.

ARTICLE III – PRIVACY POLICY

3.1 Scope

This Privacy Policy applies to any personal data collected by Amplify through its digital infrastructure, directory platform, event services, or communication systems.

3.2 Categories of Data Collected

• Identifiers (name, phone, email, title)
• Transaction data (ticketing, payments, invoices)
• Directory data (bios, headshots, credentials)
• Device and geolocation data (IP, browser agent)
• Analytics and behavioral metadata

3.3 Sources

• Online forms, ticketing platforms, and directory submissions
• Browser sessions and analytics platforms (e.g., Google Analytics)
• Email marketing systems and event registration tools

3.4 Legal Basis for Processing

• Consent – voluntary submission of forms
• Contractual necessity – processing tied to event, sponsorship, or membership delivery
• Legitimate interest – security, fraud protection, platform optimization
• Legal obligation – retention or reporting required by law

3.5 Data Use Purposes

• Operating the Platform and fulfilling user requests
• Maintaining program records and history
• Communicating with users (transactional and optional outreach)
• Protecting our legal and operational interests

3.6 Data Retention

Amplify retains user data as long as required for the above-listed purposes, necessary to comply with legal requirements (e.g., tax law), and consistent with records retention best practices (generally 3–7 years).

3.7 User Rights (Global)

• Request access to their data
• Request correction, deletion, or portability
• Object to or restrict data processing
• Withdraw consent where applicable
• File a complaint with a data protection authority

3.8 State Privacy Rights (U.S.)

Residents of CA, CO, CT, VA, UT, OR, TX (2026) have the right to: know what personal data is collected; request deletion or correction; opt out of targeted advertising or profiling; appeal denied data rights requests; and submit rights requests via privacy@amplifywomentb.com.

3.9 Data Security

• Encryption of data in transit and at rest
• Firewalls and intrusion detection
• Access restrictions and staff training
• Due diligence in selecting processors (Stripe, Eventbrite, Mailchimp)

3.10 International Transfers

Users outside the U.S. acknowledge and consent to international transfers of data, subject to Standard Contractual Clauses and equivalent safeguards.

3.11 Processors

Amplify may use third-party data processors that are contractually bound to handle data in accordance with applicable law.

ARTICLE IV – COOKIE NOTICE

4.1 Purpose

• Enable site functionality
• Monitor engagement and improve UX
• Facilitate secure transactions

4.2 Categories of Cookies

• Strictly Necessary – site loading, session tracking
• Functional – remember preferences
• Analytics – usage metrics
• Marketing – remarketing or ad personalization (only with consent)

4.3 Consent & Controls

• Adjust browser settings to block or delete cookies
• Cookie banners appear on first visit and allow opt-in/out controls
• Global Privacy Control (GPC) browser signals are honored

Cookie deployment is based on consent (for non-essential cookies) and legitimate interest (for essential cookies).

Amplify may update this Policy from time to time. Continued use of the Platform indicates acceptance of the current version.
